offenders
The alarming scourge of
juveniles involved in heinous offences and the impending release of Nirbhaya
gangrape juvenile offender owing to inadequacies in the Juvenile Justice Law of
2000 warrant for immediate passage of “The Juvenile Justice (Care and
Protection of Children) Bill” pending in the Rajya Sabha which was passed by
the Lok Sabha on May 7, 2015. The Bill permits juveniles above the age of 16
years to be tried as adults for heinous offences by children’s courts if the
Juvenile Justice Board finds the juvenile fit to be tried as an adult based on
a preliminary assessment with regard to his mental and physical capacity to
commit such an offence, ability to understand the consequences of the offence
and the circumstances in which he allegedly committed the offence.
